FiberTower's Compliance with OTARD Rules

FiberTower's antennas at customer locations transmit and received wireless signals, and are:

  • Only 2' to 3' in diameter
  • Either installed on property controlled by the user, or installed with the permission of the user's landlord

Qualification

Such FiberTower customer locations qualify for treatment under OTARD (Over The Air Reception Device) rules. Following the passage of the Telecommunications Act of 1996, the FCC issued a set of rules collectively known as the OTARD rules, under which non-federal authorities (States, Municipalities, Homeowners' Associations, and Building Owners) cannot restrict, impair or delay the installation of OTARD compliant antennas. Aspects include:

  • The user has exclusive control of the property where the antenna is located, or the landlord has granted permission to the user to mount the antenna
  • The antenna transmits or receives commercial, non-broadcast fixed wireless signals
  • The antenna is one meter or less in size
  • There is no local credible safety objective or historical site designation

The FCC explained that it implemented the OTARD rules in order to encourage competition in the market for local telecommunications services. FiberTower will fully cooperate with local zoning authorities in this regard, and fully appreciates their support.
